CD Scores Win for Henrie Capital

CD client Henrie Capital Partners, Ltd., prevailed in its suit against Hygeia Paragon Holdings, Inc., for breach of its commercial lease. Hygeia abandoned office space leased from HCP with several months of rent still owed. Although Hygeia raised several defenses, including counterclaims for constructive eviction, breach of implied warranty of suitability, and breach of covenant of quiet enjoyment, CD successfully defeated all of Hygeia’s defenses and counterclaims and won HCP’s breach of contract claim. The 296th District Court of Collin County, Texas, awarded HCP unpaid rent and late fees, attorney’s fees, costs, and both pre-and post-judgment interest.
